St. V's, nurse ruled negligent in man's death

The estate of a Toledo man was awarded $600,000 by a jury in Lucas County Common Pleas Court after a four-day trial in which Mercy St. Vincent Medical Center and one of its nurses were found to be negligent.

The lawsuit was filed in the wake of the December, 2008, death of Richard Elzay, 79.

Kyle Silvers of Shindler, Neff, Holmes, Schlageter, & Mohler said Mr. Elzay died after developing an infection from his intravenous drip because a nurse failed to switch out the IV tube after it became dislodged and fell on the floor.

The jury deliberated about six hours before returning its verdict Thursday.
