A North Toledo man was indicted Friday by a Lucas County grand jury on charges stemming from a car crash that killed his younger brother.

Zachary Fisher, 21, of 2720 106th St. was indicted on two counts of aggravated vehicular homicide — one of which alleges he was intoxicated and the other which alleges he was reckless at the time of the Sept. 11 crash.

According to Toledo police, Mr. Fisher was northbound on Summit Street near I-280 about 2:30 a.m. when he drove off the road and struck two poles before getting back on the road, spinning, and throwing his passenger, Eric Fisher, 19, out of the car. Mr. Fisher’s car then struck another car being driven by Chancellor Smith, 24.

Eric Fisher was pronounced dead at Mercy St. Vincent Medical Center. Zachary Fisher was not injured.
