Sex offender, woman indicted in rape case

A registered sex offender whom police charged with raping a 2-year-old was indicted Thursday by a Lucas County grand jury, along with the woman who allegedly left the child in his care.

Aubrey Dale Marshall, 56, of 2611 Lagrange St. was indicted on two counts of rape for the March 30 incident at a home in North Toledo.

Connie Elam, 28, of 3321 Maple St. was indicted for endangering children, stemming from the same sexual assault.

Jeff Lingo, chief of the criminal division for the prosecutor’s office, said Ms. Elam was “an adult who left the child in the care of a known sex offender.”

In 2003, Marshall was convicted in Lucas County Common Pleas Court of unlawful sexual conduct with a minor. He was sentenced to four years in prison and, as a sex offender, ordered to register his address with the county sheriff for 10 years — something he failed to do in April, according to a complaint filed in Common Pleas Court.
