After complaining his attorney was filing motions rather than bringing his murder case to trial, a Toledo man insisted Wednesday that he wanted a new lawyer even if it meant his Aug. 5 trial would be further delayed.

Lucas County Common Pleas Judge Myron Duhart granted a motion for attorney Keith Mitchell to withdraw from representing Robert F. Carter, 43, of 1143 Belmont Ave., and appointed Merle Dech to the case.

Carter is charged with aggravated murder in the Dec. 24 shooting death of his estranged wife, Wendabi Triplett, 41, at her home.

Mr. Mitchell told the court communication had broken down between him and Carter, and “I don’t believe he trusts my capabilities in this matter.”
