Ex-Toledoan seeks credit for jail time served
3/19/2014COLUMBUS — A federal appeals court on Tuesday sent a former Toledo man convicted in a northwest Ohio bank robbery spree back to U.S. District Court for his sentence to be reconsidered.
Michael McParland, 70, is currently serving a six-year sentence in federal prison at the Fort Dix Federal Correctional Institution in New Jersey after completing three years in state prison for assault for backing his car into a cruiser while trying to escape police. He pleaded guilty to the charges in 2008.
The Cincinnati-based U.S. 6th Circuit Court of Appeals said Tuesday that McPartland was entitled to ask the federal court to count his state sentence as having been served concurrently with his federal sentence, a move that could shave three years off his federal time.
“Upon remand, the district judge is free to order that the sentences be concurrent and give McParland credit for time served on his state sentence, or decline to do so,” the appeals court said. “We express no opinion on what course of action the district judge should follow.”
The charges stemmed from nine robberies of banks in Toledo, Findlay, Delta, Swanton, and Napoleon in 2007 and 2008.
