Former radio host Andrew Zepeda loses appeal

Former radio personality Andrew Zepeda lost his appeal today of conditions placed on him as part of an intervention in lieu of conviction in Wood County Common Pleas Court.

A former radio host lost his appeal today of conditions placed on him as part of an intervention in lieu of conviction in Wood County Common Pleas Court.

Andrew Zepeda, 45, of Perrysburg was granted intervention in 2011 after he pleaded guilty to theft, complicity to breaking and entering, and failure to remit sales tax for incidents related to a pizzeria he ran at Levis Commons in Perrysburg. As part of the two-year intervention, Judge Alan Mayberry ordered Zepeda to not frequent any businesses or other places where alcohol is served.

Zepeda’s intervention was terminated in 2012 after it was shown he had been at more than one venue where alcohol was served. The court then found him guilty of the charges and sentenced him to 30 days in jail and five years’ community control.

Ohio’s 6th District Court of Appeals said the intervention's terms were not unreasonable, as Zepeda alleged in his appeal.

“The argument that [Zepeda] believed that the conditions were too onerous is not a basis for reversal,” the court wrote. “[Zepeda] was not required to agree to the terms of intervention and could have opted to proceed with the criminal prosecution.”

Zepeda, who had been host of the weekday drive-time show Andrew Z in the Morning on WWWM-FM 105 (Star 105), was fired by Cumulus Media, Inc., following his conviction on the charges.
