Toledoan, 24, charged in murder is re-indicted

A Toledo man charged with fatally shooting a man in East Toledo was re-indicted Wednesday on new charges.

Deontay Smith, 24, of 418 Dexter St., was indicted by a Lucas County grand jury for aggravated murder, murder, two counts of felonious assault, discharge of a firearm on a public road, participating in a criminal gang, and tampering with evidence. The charges stem from the death of Michael Macklin, Jr., 20, of Toledo who was driving a vehicle Feb. 2 when it was struck by five shots near Greenwood and Alden avenues.

The charges carry specifications that Mr. Smith used a firearm, that he discharged a firearm from a motor vehicle, and that he acted as part of a criminal gang. Prosecutors said more evidence was presented to the grand jury resulting in the new indictment. In March, Mr. Smith was indicted for murder and participating in a criminal gang.
