Man gets community control for stabbing role

For his part in a fight on the University of Toledo campus that seriously injured two people, Emilio Cloyne was placed on community control for three years Monday.

Lucas County Common Pleas Judge Linda Jennings also ordered Mr. Cloyne, 19, of 1408 Oakmont St. to spend 30 days on electronic monitoring, perform 75 hours of community service, abstain from drugs and alcohol, be screened for the need of treatment for substance abuse, and have no contact with the victim.

Mr. Cloyne entered an Alford plea May 5 and was found guilty of misdemeanor assault for participating in the attack on Joseph Bialecki after Bialecki got into a fight with and stabbed Mr. Cloyne’s friend Cody Halka on Aug. 23.

Judge Jennings cited Mr. Cloyne’s lack of a criminal record but said she found him “indifferent and nonchalant” about a very serious incident.

The Alford plea means that Mr. Cloyne did not admit he was guilty of the crime but conceded that the evidence was sufficient to convict him.
