Grand jury declines murder indictment
A Lucas County grand jury has declined to indict a Sylvania man on a murder charge for the shooting death of a man who was breaking into his home.
Clay Hausenfleck, 46, called 911 just after 1 a.m. Aug. 28 to report he had shot an intruder after a break-in at his Williamsburg Drive home. Officers reported finding the body of Louis M. Mason, 28, of Toledo, who died of two gunshot wounds. They also reported finding more than 200 marijuana plants.
Mr. Hausenfleck has been charged with one count each of possession of marijuana, trafficking in marijuana, and illegal cultivation of marijuana in connection with plants found in his home.
If convicted on the drug charges, he faces up to 21 years in prison. He will return to court Nov. 20 before Judge Stacy Cook.
Three people arrested in connection with the break-in will be in court for a hearing today. Billy D. Wilkinson, 33, of 5123 Ryan Rd. and David A. Irving, 31, of 3907 Bancroft St. are each charged with aggravated burglary, and Julie A. Britton, 25, of 2345 Saint Roberts Lane is charged with complicity to aggravated robbery. Police believe the intruders broke into the house to steal drugs.
