Damschroder lawsuit grows
Relative of 2 victims joins action arising from plane crash
A relative of two of the victims who died in the crash of a single-engine plane piloted by Gene Damschroder during a Lions Club event has joined in a lawsuit already filed in Lucas County Common Pleas Court and yesterday filed a complaint alleging negligence and wrongful death.
The complaint was filed by Andrew Ansted on behalf of his father, William Ansted, 62, and sister, Allison, 23, who both died June 8, 2008, when the small plane they were passengers in crashed into a field near Fremont.
Also killed in the crash were Danielle Gerwin, 31, and her daughter, Emily, 4, both of Gibsonburg, and Matthew Clearman, 25, of Maumee. Mr. Damschroder, who was 86, also died in the crash.
Mr. Ansted joins the complaint filed March 24 by Mrs. Gerwin's husband, Charles, and Mr. Clearman's father, James Clearman of Livonia, Mich.
The lawsuit asks for damages in excess of $15 million.
In the complaint, Mr. Gerwin and Mr. Clearman cite the National Transportation Safety Board's preliminary report that the plane was flying at a low altitude and was not on a flight plan. Since the filing of the original lawsuit, a second NTSB report was released citing Mr. Damschroder's diagnosis of macular degeneration and the notation of a now-decertified airman medical examiner who listed Mr. Damschroder's uncorrected distance vision and near vision as 20/20 in each eye - information that was directly contradicted by records from his retinal specialist.
