Ohio law offers protections for landlords, tenants
|
Dear Dale: When my daughter went to college, she responded to a blind e-mail to sublet an apartment with four women she didn’t know. It turned out to be a nightmare. The first two nights, her roommates and their friends partied until 6 a.m. The third night, her roommates hosted a pot party. My daughter left to stay with a girlfriend on campus.

Can manager take legal action against trespassers?
Dear Dale: I manage an apartment complex that provides housing for median-income households. We are having a recurring problem with people who are not residents loitering in our hallways. They are not guests of our residents. Is there a procedure that will allow me to issue a trespassing notice to these individuals that will be enforced by the police?

If a 6-year-old injures another child, who pays?
Dear Dale: Recently at a local sporting facility, my 5-year-old daughter was injured by her 6-year-old stretching partner. My daughter says she told the girl to stop pushing because it hurt, while the other little girl says she didn't do it on purpose. My daughter suffered a pubic bone fracture and muscle tears.

Is homeowner liable if dog bites sitter?
Dear Dale: Last year a woman who was baby-sitting our children in our home for the summer was bitten by our dog while she was playing tug-of-war with it. Our homeowner’s insurance company won’t cover us for our sitter’s claim because it says she was an employee in our home. Do I have a defense under the dog bite statute? Also, will workers compensation come into play?

Do frequent break-ins permit breaking lease?
Dear Dale: After moving into an apartment complex earlier this year, my apartment was burglarized and I had a lot of my things stolen. The burglar kicked in my door, which the complex replaced by piecing together the same flimsy door frame and lock. Not long afterward my door again was kicked in, and the complex again used the same type of lock.

Pizza was disgusting, but maybe not actionable
Dear Dale: When my husband and I were eating our carry-out pizza recently, my husband bit into a piece of a condom that was stuck inside the cheese. You can imagine how furious he was, especially when the pizza shop ignored him when he tried to complain. We’ve never sued anyone before, but we’re both mad enough that we wanted to know our options.

Driver's case hinges on issue of negligence
Dear Dale: While driving down a country road, I came around a turn and spotted cows in the road. I could not stop in time and I struck a cow. I ended up being injured in the accident. Is the person who owned the cows responsible for my injuries? A friend of mine said cows from the same farm have been on that road on other occasions.
