Michigan contractor sued by Cedar Fair

Cedar Fair LP is suing a Michigan company for breach of contract after the firm reportedly failed to complete work last year for a new ride at Cedar Point.

A complaint filed in U.S. District Court in Toledo says that Rock & Waterscape/RWSI Inc. of Auburn Hills, Mich., and its related companies were hired in late 2009 to make and install faux rock components for the "Shoot the Rapids" roller coaster. Cedar Fair made advance payments of nearly $226,000 for the work, which was expected to cost $524,000 in total and was scheduled for completion in May, 2010.

Cedar Fair says Rock & Waterscape agreed to back out of the project in March, 2010, when it believed it would miss the deadline. The Sandusky amusement park operator said the contractor agreed to repay more than $222,000 after leaving the project but allegedly has failed to do so.

Cedar Fair is seeking compensatory damages of at least $222,175, plus punitive damages and attorney's fees.
