Jeremiah Michaels, 25, was found dead in the bin of his cement-mixer truck Sept. 6, 2001 after making a delivery near Alvada, Ohio. His wife, Tamara, filed a lawsuit Thursday in Seneca County Common Pleas Court seeking $25,000 in compensatory damages and $25,000 in punitive damages.

Mr. Michaels had been working for Palmer Brothers Transit Mix Concrete, Inc., for about two months when the accident occurred. The company is headquartered in Bowling Green but has a branch in Fostoria.

Mrs. Michaels alleges in the lawsuit that the company did not train her husband properly. She also claims that the manufacturer, Advance Mixer, Inc., of Fort Wayne, Ind., did not install necessary safety equipment on the truck.

Mr. Michaels was allegedly cleaning out the bin of the truck at the time of the accident.
