Court considers trial as adult for teen accused of fatal shooting

A Lucas County Juvenile Court judge will determine Wednesday if a 16-year-old accused of fatally shooting a young woman and injuring another girl will be tried as an adult.
Emanuel Garner, 16, appeared Tuesday before Judge Denise Navarre Cubbon for a probable cause hearing for charges of murder and felonious assault.
He is accused of shooting and killing De'Asia Wallace and injuring Tanaysia Young following a large street fight in the 1800 block of MaComber Street Sept. 24, according to Toledo police.
If convicted of murder, the teenager could face 15 years to life in prison.
Prosecutors requested the teen be tried as an adult, while the youth's attorney, Ann Baronas, said the investigation has not been completed.
The Young and Garner youths were each shot in the leg, investigators said. Miss Wallace suffered a fatal gunshot wound to the chest, according to a Lucas County Coroner's Office preliminary report.
A witness told investigators a group of youths began fighting in the area on Sept. 23. The fight spilled into the next day, but with different people.
Lori Olender, deputy chief of the county prosecutor's juvenile division, played a segmented portion of a video from the incident. It began with multiple people gathering in the intersection of MaComber and Isherwood streets. Several teenage girls began taking swings at each other and pulling each others’ hair, the video shows.
The crowd moves down the street, and the person behind the camera follows. According to Toledo Police Detective Paul Marchyok, several members in attendance went up a hill, in front of a home, which sits back about 150 feet from the street. The video catches a group of youths, including the Garner teen, walking to the home.
While no shooting is captured on the video that was played in the courtroom, several gunshots can be heard.
The detective testified Tuesday that shots fired near the porch area of the home came from a 9mm handgun, the same type of bullet retrieved from Miss Wallace's body, he said.
A second shooter, who has yet to be identified by witnesses, was also allegedly shooting toward the home, said Detective Marchyok. That person was standing in the yard and was shooting with a .38 or .357 revolver, he said. One of those rounds struck the Garner youth.
The Garner teen later took himself to Mercy Health St. Vincent Medical Center for treatment, while the two females were treated at ProMedica Toledo Hospital, a closer location to the shooting incident, said Detective Marchyok.
Detective Marchyok said he has interviewed 14 people from the incident.
The Garner youth is scheduled to appear in court at 9 a.m. Wednesday.
