3 charged in officer-involved shooting at Toledo carryout

Authorities have charged three people in a police-officer involved shooting at a carryout near the Old West End, according to court documents. 

Richard Morris, Jr., 26, of the 1000 block of Markham Court, and Jayvon Wynne, 22, of the 700 block of Blum Street, are both charged with felonious assault, a first-degree felony. Additionally, Phillip Overton II, 22, of the 1200 block of Mason Street, is charged with improperly handling a firearm in a motor vehicle, a fourth-degree felony. 

A Toledo Municipal Court judge set bond Thursday at $250,000 for Mr. Overton.

Toledo police shot two men at a carryout near the Old West End after being fired upon Wednesday evening, according to Toledo Police Department spokesman Sgt. Kevan Toney. 

The gunfire exchange occurred at the Monroe Carryout, 2829 Monroe St., about 7:30 p.m.

Mr. Wynne is accused of firing two rounds from a 9 mm handgun at Toledo Police Officer Norman Cairl and fleeing the scene, according to an affidavit filed in Toledo Municipal Court. While being pursued by police, he then pointed the gun at Toledo Police Sgt. Duane Poole after the officer identified himself, court documents show. 

Mr. Morris is also accused of fleeing the scene of the shooting when he too pointed a loaded handgun at Sergeant Poole, who identified himself as an officer, according to an affidavit filed in Toledo Municipal Court.

Mr. Morris and Mr. Wynne, 22, were both shot, police said. It was not specified as of early Thursday which officer fired the shot or how many shots were fired. 

Their wounds were not life-threatening. Emergency communications indicated one was shot in the buttocks and the other in a shoulder.

Further details about their condition or location were not released.

Seargeant Toney said on-duty officers returned fire after being shot at — but not hit — in the carryout’s parking lot.

The statement police issued later said detectives from the department’s Special Intelligence Section “were conducting surveillance in relation to recent gun violence” when the incident occurred. Two veteran detectives — one a sergeant — were involved and unhurt, the statement said.After the shootings, Mr. Overton was taken into custody without incident, according to police. He was the driver of the vehicle that transported a loaded 9 mm handgun inside the passenger compartment, according to court documents. 

Mr. Overton is scheduled to appear in Toledo Municipal Court at 9 a.m. Thursday. Court dates for Mr. Morris and Mr. Wynne were not immediately available. 

Police said they are not looking for any other suspects involved in the officer-involved shooting.

A crowd gathered at the scene afterward. As more than a dozen officers lined up with their arms crossed, a woman shouted at them that one of those shot was her son.
