Attempted murder count against man dismissed

A case of “misidentification” led to the dismissal of charges against a Central Toledo man in Lucas County Common Pleas Court Monday.

James Dunn, 40, of 1060 Blum St. was indicted last month on one count of attempted murder and seven counts of felonious assault. He was accused of shooting a man who lives on his block multiple times.

Judge Gene Zmuda dismissed the case Monday at the request of the prosecutor’s office. According to Assistant County Prosecutor Michael Loisel, further inquiry revealed that the victim, Brandon Braggs, likely misidentified Dunn as the man who shot him.

Dunn, who was on electronic monitoring as a condition of his bond, was told he was free to go. Judge Zmuda noted that because the case was dismissed “without prejudice,” charges could be refiled against Dunn if necessary.
