Former Toledo prison inmate is indicted

A former inmate at Toledo Correctional Institution has been indicted by a Lucas County grand jury on two counts of assault and one count of possession of a deadly weapon while under detention.

Richard Penque, 25, had been transferred to the Lucas County jail to await trial on a separate assault charge for allegedly assaulting a guard at the Toledo prison when he allegedly punched county sheriff’s Deputy Pat Mangold Jan. 11. Deputies also said they found a toothbrush sharpened into a shank in his cell.

Penque, who is serving a life sentence for aggravated murder from Cuyahoga County, was ordered Jan. 30 to be evaluated at the Court Diagnostic and Treatment Center. He is set to appear before Common Pleas Judge Myron Duhart on March 4 for a hearing to determine his competency to stand trial on the original assault charge.
