Mom’s trial in baby’s death put off for testing

With the recent disclosure that Toledo police had recovered a splash of blood from a bedroom wall that a 6-month-old boy was allegedly thrown against, his mother’s trial for aggravated murder was again postponed Tuesday.

Lucas County Common Pleas Judge Frederick McDonald vacated the jury trial of Amanda Bacon, 26, of 504 W. Alexis Rd., which was to begin Friday with jury selection. Instead, the judge plans to hold a hearing Friday to determine who should test the blood sample for DNA: the Ohio Bureau of Criminal Identification and Investigation as prosecutors contend or an independent lab as defense attorneys prefer.

“BCI is an agent of the state. They’re not an independent lab,” defense attorney Spiros Cocoves told the court.

Ms. Bacon is charged in the December, 2012, death of her infant son, Avery Bacon, but her attorneys say they intend to argue a man with whom she was living at the time killed her son.
