Ruling due April 21 in 2011 home invasion

After a three-day bench trial before Lucas County Common Pleas Judge Myron Duhart, a Toledo man charged with shooting a man during a home invasion will learn his fate April 21.

Judge Duhart said Wednesday he would announce a verdict at 1:30 p.m. April 21 in the case of Xzavier Matthews, 22, of 711 Pearl St., who is charged with burglary, aggravated burglary, felonious assault, attempted murder, aggravated robbery, and grand theft of a motor vehicle.

Prosecutors allege Matthews broke into the Colorado Street home of Frank and Jackie Gacsal on Aug. 28, 2011, shot Frank Gacsal in the face during a struggle, and stole the couple’s car, TV, and other items.

Mrs. Gacsal took the stand during the trial, positively identifying Matthews as the intruder who shot her husband, while her husband testified that he never saw the man’s face before he was shot in the corner of his eye.
