Judge maintains hefty bonds for shootout suspects

Lucas County Common Pleas Judge Gene Zmuda on Wednesday refused to reduce the hefty bonds set for three men charged in a shootout with Toledo police outside a carryout last month.

Jayvon Wynne, 22, of the 700 block of Blum Street, Richard Morris, Jr., 26, of the 1000 block of Markham Court, and Phillip Overton, II, 22, of the 1200 block of Mason Street all remained held Wednesday in the Lucas County jail.

Mr. Wynne and Morris, who allegedly fired shots at two officers, are charged with two counts of felonious assault and a weapons charge, while Mr. Overton, who was allegedly driving the car, is charged with complicity to felonious assault and improperly handling firearms in a motor vehicle.

Mark Herr, an assistant county prosecutor, told the court the high bonds were warranted.

“It was very serious circumstances that involved a shooting at police officers out on the city streets,” Mr. Herr said. “We believe that there is a significant risk to the community based on the conduct of these individuals that led up to the exchange of gunfire.”

Mr. Wynne and Morris both were wounded in the Dec. 6 exchange outside the Monroe Carryout, 2829 Monroe St., although the two officers involved were not struck.

Judge Zmuda continued Mr. Wynne’s bond at $1 million, Morris’ bond at $575,000, and Mr. Overton’s bond at $500,000.
