A Toledo man charged with the 2009 beating deaths of an elderly couple in their Mulberry Street home entered a plea in Lucas County Common Pleas Court Thursday in an agreement to avoid the death penalty.

Edgar Howard, 49, entered an Alford plea to two counts of aggravated murder. As part of the negotiated plea, the state removed the death penalty specifications and dismissed one count of aggravated robbery.

As part of the deal, it was agreed that Howard will serve two consecutive life sentences without the possibility of parole. Judge Gary Cook sentenced Howard to life in prison.

Authorities say Frances Fox, 88, died during a May, 2008, attack in her home at 3373 Mulberry St. Her husband, Kenneth Fox, 75, died in December of that year in the Darlington House nursing home.

A coroner's ruling established that Mr. Fox died from complications of injuries suffered in the assault.
