City of Toledo seeks to acquire Orchard St. property

The City of Toledo has filed a petition for appropriation to try to obtain land needed to complete a storage basin project.

The complaint was filed in Lucas County Common Pleas Court Thursday against The Four Howard's, Ltd., as well as its mortgage company and various other creditors. The petition asks the court to direct the appropriation of the needed land and determine the fair value of the parcel.

According to the complaint, the city has been hindered from negotiating the purchase because of a pending foreclosure action against the property on Orchard Street in Toledo.

The city noted that it requires portions of the property to construct a "road to a storage basin for the improvement, reduction, and/or elimination of certain combined sanitary storm water drainage overflow into the Maumee River."

The case was assigned to Judge James Jensen.
