Judge dismisses Taser suit against city, police

A federal judge dismissed the claims of a Michigan woman who filed a lawsuit saying Toledo police officers used a Taser on her during an arrest at a Dec. 10, 2005, neo-Nazi rally in downtown Toledo.

Elizabeth O’Brien of Lansing filed the complaint in U.S. District Court in Toledo against the city, Chief Mike Navarre, and Sgt. Michael McGee, first in 2007 and then refiled it in 2010. The complaint asked for more than $25,000 in damages, and claimed false arrest, failure to train, and municipal and supervisor liability.

In a written order filed Wednesday, Judge James Carr said as a matter of law, Ms. O’Brien would not be able to prevail and granted a motion for summary judgment.

Ms. O’Brien can appeal to the federal appellate level.
