Top state court upholds ruling on murder appeal

COLUMBUS -- The Ohio Supreme Court Tuesday upheld a Lucas County Common Pleas court ruling on Carlos Galloway's appeal of his convictions and sentences in the 1993 execution-style slayings of two brothers.

Galloway, 42, is serving consecutive life sentences in the Mansfield Correctional Institution for the shooting deaths of Michael Moore, 25, and his brother, Kevin Moore, 19, outside the Brand Whitlock Homes on Nebraska Avenue.

A jury convicted Galloway in June, 1994, of aggravated murder and two gun specifications in the shooting deaths, but spared him from the death penalty.

Galloway sought a complaint in Common Pleas Court on the grounds that the judge didn't comply with state sentencing rules. However, Judge Denise Dartt ruled against the action.
