Ex-UT athlete sentenced for assault charge
11/18/2011A former University of Toledo football player was sentenced to two years of probation in Lucas County Common Pleas Court Wednesday for the May assault of a former girlfriend.
Damien McIntosh, 21, pleaded no contest and was found guilty in October for punching his former girlfriend in the face while she was driving. The victim, Christina Tomusko, who has left the area, suffered a nasal fracture, authorities said.
Judge Gene Zmuda ordered McIntosh to pay $1,407.94 in restitution to the victim for medical expenses and lost wages, and undergo anger management and batterers' counseling. The judge also ordered that he is prohibited from having alcohol in his system at any time during his probation. The judge suspended a six-month sentence at the Corrections Center of Northwest Ohio, which would be imposed if he fails to abide by the conditions of his probation, the judge ordered.
Mr. McIntosh, who is no longer enrolled at UT, was a passenger in Ms. Tomusko's car about 3 a.m. May 20 as she was driving on Secor Road. At the time, Mr. McIntosh was intoxicated and during the drive, he became angry and punched the victim in the face several times, authorities said.
At the time, Mr. McIntosh was a defensive end on UT's football team. Soon after, he was permanently removed from the program.
