Appeals court rules against Disney in suit

SAN FRANCISCO -- Walt Disney Co. must consider letting disabled customers use Segway scooters at its theme parks, the U.S. Appeals Court in San Francisco said Tuesday.

The court overturned a judge's decision throwing out a lawsuit by a woman with muscular dystrophy who said Burbank, Calif.-based Disney violated the Americans with Disabilities Act by not allowing her to use a Segway.

The court ruled that Disney must take into account evolving technologies. It sent the case back to the trial court in Santa Ana, Calif.
