A foreclosure trial against the Spitzer Building’s owner will resume Jan. 8 in Lucas County Common Pleas Court after five hours of testimony Tuesday from the defendant.
Much of what Koray Ergur argued Tuesday before Judge Gary Cook centered on emails and documents involving rent receipts, utility bills, and other expenses for the 10-story downtown Toledo building and the nearby Nicholas Building, part of the lawsuit filed in January, 2011, by the Spitzer Building Co.
Mr. Ergur, who is representing himself, contends that he is entitled to any profit that could be generated if the Spitzer is auctioned at a sheriff’s sale to collect back property taxes.
Last week, three corporations controlled by Mr. Ergur were found to be in default on mortgage payments for the Spitzer, which he bought in April, 2009. Litigation now centers on how much he owes. Spitzer Building Co. lawyers are seeking repayment of outstanding debt, maintenance costs, and legal expenses incurred by the receivership.
