Judge sentences man to 13 years in shooting

Telling him he was lucky the two men he shot lived to tell about it, Lucas County Common Pleas Judge Linda Jennings sentenced Charles Hayes on Wednesday to 13 years in prison.

Hayes, 24, of 2353 Ward St. pleaded guilty Jan. 11 to attempted murder with a firearms specification stemming from a June 9 shooting at the Valero gas station at 3365 Monroe St. Marvin Davis, 31, was shot five times, and Erroll Brewer, Jr., 24, was struck once.

“I wonder if you realize how fortunate you are to be here today on an attempted murder offense instead of a murder,” Judge Jennings said.

Defense attorney Phillip Carlisle said his client had taken full responsibility for what he did. “He knows there are no excuses,” he said.

Two counts of felonious assault were dismissed as part of a plea agreement.
