Lucas County Common Pleas Judge James Bates on Monday gave the city of Waterville and a citizens’ group seeking to put a referendum on the ballot until Feb. 19 to file briefs in the case.

The Ad Hoc Committee of Waterville Citizens for Referendum Petitions asked the court to order the city to let a referendum advance to the ballot that would reverse council’s decision to amend a development plan on Waterville-Monclova Road. The group also wants construction halted.

Council agreed Oct. 8 to let a developer build apartments rather than condos, a decision the city says is not subject to referendum.
