Re-sentencing hearing scheduled for man convicted in officer's death

Prosecutors want a Lucas County Common Pleas judge to reconsider plans to re-sentence Robert Jobe, who was convicted in the 2007 shooting death of Toledo Police Detective Keith Dressel.

Jobe, 20, who is serving 18 years to life in prison, was moved to the Lucas County jail from the Mansfield Correctional Institution recently in advance of a Feb. 25 re-sentencing hearing before Judge Myron Duhart.

Jeff Lingo, chief of the criminal division for the prosecutor’s office, said the request for re-sentencing by Columbus lawyer Mark Miller stemmed from language about post release control, formerly known as parole, that was included in the court’s journal entry but never spoken by the court at Jobe’s 2007 sentencing. Mr. Lingo contends there are methods for the court to correct the entry “short of holding a full re-resentencing.”

Mr. Miller disagrees. "A court speaks through its journal entries," he wrote in a filing with the court. "The language used in the Defendant's entry specifically notifies the Defendant of post release control."
