Mental illness plea accepted in attack

TIFFIN — Prosecutors and the defense attorney for a Tiffin man charged with attempted murder has accepted a report finding he “lacked the capacity to know the wrongfulness of his actions.”

Jack R. Berry, 33, was evaluated by Lucia Hinojosa, a psychologist with the Northwest Ohio Psychiatric Hospital, after entering a plea of not guilty by reason of insanity in the June, 2012, attack on Robin Borger, a staffer at a group home in Tiffin where Mr. Berry lived. In the report Monday, Ms. Hinojosa found that Mr. Berry is mentally ill and that his disease interfered with his functioning when he attacked Ms. Borger.

Initially found incompetent to stand trial, he was found on July 30 to have been restored to competency after nearly a year in treatment. Seneca County Common Pleas Judge Michael Kelbley set another hearing for Sept. 12.
