Parent cites negligence in lawsuit against TPS

A Toledo woman filed suit Monday against Toledo Public Schools, claiming school officials failed to seek medical attention for her daughter or notify her that her daughter was ill on a class trip to Washington, D.C., last May.

In the complaint filed in Lucas County Common Pleas Court, Sarah Kroggel alleges TPS and four employees of Beverly Elementary School were negligent in refusing to get help for her eighth-grade daughter, who was nauseous and vomiting for much of the four-day trip. The young girl was hospitalized for severe dehydration and gastroenteritis when she returned home, the suit states.

“Teachers must be properly trained to err on the side of caution when caring for children and provide full disclosure to parents at all times, which was clearly not the case,” attorney Chuck Boyk, who filed the suit, said in a news release.

The suit, assigned to Judge Gary Cook, seeks damages in excess of $25,000.
