Court orders review of ex-Toledoan’s sentence

COLUMBUS — A federal appeals court has sent a former Toledo man convicted in a northwest Ohio bank robbery spree back to U.S. District Court for reconsideration of his sentence.

Michael McPartland, 70, is serving six years in federal court at the Fort Dix Federal Correctional Institution in New Jersey. He completed three years in state prison for assault for backing his car into a cruiser while trying to escape police. He pleaded guilty to those charges in 2008.

The Cincinnati-based U.S. 6th Circuit Court of Appeals said Tuesday that McPartland was entitled to ask the federal court to count his state sentence as having been served concurrently with his federal term, a move that could shave three years off his federal time.

The appeals court said, “We express no opinion on what course of action the district judge should follow.”

The charges stemmed from nine robberies of banks in Toledo, Findlay, Delta, Swanton, and Napoleon in 2007 and 2008.
