UT faculty union wins appeals judges’ ruling

The University of Toledo lost its bid on Friday to get an arbitrator's decision in favor of UT's faculty union overturned.

Ohio’s 6th District Court of Appeals sided with an earlier Lucas County Common Pleas Court ruling to uphold the arbitrator's decision, which stated the UT administration violated its contract with the local American Association of University Professors when it failed to consult the Faculty Senate about a plan to reorganize academic colleges.

The university claimed in its appeal that the arbitrator had exceeded her powers with the decision she rendered in January. But the appeals court said the arbitrator’s decision “was based upon a reasonable interpretation of the [collective bargaining agreement].”

The decision came too late to affect a reorganization plan implemented in 2010, though.
