Co-pilot, who is sole survivor, to give video deposition in Comair crash case

LEXINGTON, Ky. The co-pilot and lone survivor of a deadly plane crash that killed 49 people will be interviewed later this month by attorneys for families suing regional airline Comair.

According to a court filing in Lexington, Ky., James Polehinke (pohl-HING'-kee) is set for a videotaped deposition on April 22 near his home in Margate, Fla.

Polehinke lost a leg and sustained broken bones and brain damage after Comair 5191 crashed near the Lexington airport on Aug. 27, 2006, while trying to depart from a runway that was too short. Polehinke was at the controls.

Comair is based near Cincinnati in Erlanger, Ky.

Until now, Polehinke has been medically unable to provide a deposition. He also didn't speak to the National Transportation Safety Board for its investigation into the crash.
