Mayor Carty Finkbeiner will not be in Toledo Municipal Court today for a probable-cause hearing on charges filed against him by the owner of Pepe's Mexican Restaurant & Cantina.
The mayor's attorney, Robert Kaplan, said he plans to waive the mayor's right to the scheduled hearing and enter a not guilty plea on Mr. Finkbeiner's behalf.
The case is expected to be scheduled for arraignment or for a hearing, said Margaret Thurber, clerk of courts.
Pepe's owner John Skiadas filed misdemeanor charges of interfering with civil rights, coercion, and disorderly conduct against the mayor last month in connection with a July 14 incident between the two at Pepe's.
Mr. Kaplan said he would request the prosecution provide a bill of particulars, a legal document that describes the allegations behind the charges.
