A man was arrested yesterday after he refused to leave an East Toledo garage for about 90 minutes.

Walter Whitten, 24, was charged with misconduct at an emergency and weapons under disability.

He also was booked into the Lucas County jail on unrelated warrants. He is scheduled to be arraigned today in Toledo Municipal Court.

Police went to a garage at 744 Valleywood Drive about 8:20 a.m. to take a burglary report. Mr. Whitten, who was sleeping in the upstairs of the garage, said he stopped a burglary during the night, that he had to shoot one of the burglars, and that he fired three shots into a car in the garage.

Police found Mr. Whitten lying on a makeshift bed in the garage. He didn t want to talk with police who then used gas to get him out. He was arrested without further incident.

Police found two loaded revolvers and a rifle under the bed covers and two more rifles, three packages of suspected marijuana, and assorted pills in packages near the bed.
