Man who hit 2 women with truck isn t indicted

A Lucas County grand jury decided not to indict a Toledo man who was driving under the influence of alcohol when he struck two women, killing one and injuring the other.

Prosecutors yesterday asked the panel to indict Kevin Fuller on charges of aggravated vehicular homicide and aggravated vehicular assault for the March 12 accident on Starr Avenue at East Broadway.

Tammy Shular, 40, of 335 Palmer St. and Cherie Seibers, 35, of 348 Dennis Ct. had just begun to cross Starr when they were struck by Mr. Fuller s westbound pickup.

Ms. Shular was pronounced dead at the scene; Ms. Seibers was hospitalized at St. Vincent Mercy Medical Center.

Police said Mr. Fuller, 24, of 4207 Asbury Drive had a blood-alcohol level of 0.157 percent, nearly twice the legal limit in Ohio for a motorist. The women had just left Rookies Bar.

Witnesses told police that Mr. Fuller drove through a green light and the women had a Don t walk signal. Also, two cars parked along the north curb of Starr obstructed the view of the women from Mr. Fuller s pickup and possibly his truck from them.

Mr. Fuller told investigators that he didn t see the women until they stepped in front of his truck.
