Felony drug charges were dismissed Monday against two Toledo men charged with operating a mobile methamphetamine lab.

Lucas County Common Pleas Judge Gene Zmuda granted a motion to suppress the search of Vincent Doyle’s car, which was stopped and searched last February by Toledo police following a traffic stop.

Mr. Doyle and his nephew, Christian Doyle, each were charged with illegal assembly or possession of chemicals for the manufacture of drugs after police found a bookbag inside the car that contained items to make methamphetamine. The judge said police searched the car based on suspicious actions taken by a passenger in the car who was never charged. Those actions were not sufficient for probable cause to search Mr. Doyle’s car, Judge Zmuda ruled.

Kate Sandretto, an assistant Lucas County prosecutor, said that if further evidence is discovered, charges could be re-filed.
