Curt overturns conviction in death of drunk motorist

COLUMBUS — A former Ohio State Highway Patrol trooper will try to get his job back after an appeals court overturned his conviction in an incident where an intoxicated man ended up dead.

The 5th District Court of Appeals this week found that former trooper Sean Carpenter was not negligent when he left the 22-year-old intoxicated man with two sheriff’s deputies on July 28, 2012. The deputies dropped off the man at a Taco Bell, and he was later hit by a car and killed while walking along a road.

The court overturned Carpenter’s conviction for dereliction of duty.

Carpenter’s attorney tells The Columbus Dispatch that he will appeal his firing during a hearing next month.

The appeals court upheld the conviction of one of the Delaware County deputies involved.
