Tentative dismissal issued in toy maker case

SANTA ANA, Calif. — U.S. District Judge David O. Carter issued a tentative ruling yesterday that dismisses an anti-trust lawsuit by MGA Entertainment against Mattel Inc. in the latest spat between the two toy makers battling for supremacy in the fashion doll market.

Judge Carter said the action is based on the same facts as litigation that awarded MGA nearly $310 million.

He took the case under consideration after the companies' lawyers argued their points yesterday. MGA, which makes the pouty-lipped Bratz dolls, filed its anti-trust suit against Mattel, which makes Barbie, in February.
