Appellate court returns lawsuit to Ottawa County

5/19/2001

PORT CLINTON - An appeals court has sent a lawsuit filed by a former Put-in-Bay Township trustee back to the Ottawa County Common Pleas Court.

Nello Bianchi sued Auto Owners Insurance Co. in 1998, arguing that he and his wife, Justine, deserved insurance coverage after an uninsured driver struck him in 1997.

The accident critically injured Mr. Bianchi as he was walking to township hall.

In his lawsuit, Mr. Bianchi claimed that he should be covered under the uninsured motorist provision of the township's automobile liability policy.

The Common Pleas Court ruled that he was not insured under the policy.

But the appellate court found that there was case law that could provide him with coverage; therefore, the case was returned for additional consideration by the Common Pleas Court.
