SANDUSKY - An Erie County man has been sentenced to serve eight years in prison for fatally shooting a Norwalk man during an argument in April.

Thomas Wasily, 44, was sentenced Tuesday by Judge Ann Maschari of Erie County Common Pleas Court to five years for voluntary manslaughter in the death of Bradley Hackathorn, 38, and three years for using a gun to commit the crime. The sentences will be served consecutively; Wasily could have been given up to 10 years for the manslaughter conviction.

K. Ronald Bailey, Wasily's attorney, has filed a motion seeking a new trial, alleging misconduct by Prosecutor Kevin Baxter and claiming the discovery of new evidence that could exonerate Wasily. A hearing is set for 9 a.m. Dec. 14.
