2nd competency test is ordered by judge

A Toledo man charged in a traffic accident that killed a college football official will be evaluated again to determine if he is competent to stand trial in Lucas County Common Pleas Court.

Deeb Mashni, 29, of 40 Tiffany Square Drive, was ordered by Judge Ronald Bowman to undergo a second evaluation at the Court Diagnostic & Treatment Center.

A staff psychologist who interviewed Mr. Mashni recently determined that he is not competent to stand trial on charges of aggravated vehicular homicide and vehicular assault.

Prosecutors asked Judge Bowman for the second evaluation by another psychologist. Mr. Mashni will be evaluated and returned to court Jan. 29 for a hearing.

Mr. Mashni pleaded not guilty by reason of insanity Nov. 26. He is charged in the Oct. 27 accident on Monroe Street at Douglas Road in which Michael Perry, 46, of Amherst, N.Y., was killed, and George Santoro, of Hamburg, N.Y., was hurt.

Mr. Perry was the field judge for the University of Toledo-Miami University game. Mr. Santoro was the umpire.

Mr. Mashni is being held in the Lucas County Jail in lieu of $25,000 bond.

Police said Mr. Mashni's minivan was traveling on Douglas at 55 to 65 mph about 1:30 a.m. when he ran a red light and hit the westbound car of Mr. Perry. The speed limit is 35 mph.
