Resentencing ordered in Findlay shooting

FINDLAY The 6th District Court of Appeals has ordered that a Lima woman be resentenced for shooting the man who killed her son during an altercation last year.

Annie M. Harris, 45, was given a six-year prison term in October, 2004, after pleading guilty to a charge of felonious assault. As part of a plea agreement in Hancock County Common Pleas Court, an attempted murder charge was dismissed.

Harris shot John McDonald, Jr., 24, of Lima in a Findlay apartment Jan. 31, 2004, shortly after John McDonald fatally shot his half-brother, Quincy McDonald, 20. John McDonald is serving a 13-year prison term for involuntary manslaughter.

In a ruling issued yesterday, the appeals court said Judge Reginald Routson failed to discuss the possibility of post-release control when he sentenced Harris.
