Court date delayed for 25 suspects

12/12/2005

The 25 adults charged with misdemeanor offenses have to wait until today to be arraigned in Toledo Municipal Court after a session planned for yesterday was canceled.

Court officials had agreed prior to the rally that if more than 25 people were charged they would hold arraignment on Sunday, a day the court is usually closed.

But because of the small number of arrests, they were instead added to today's docket.

"We had this whole thing planned out really well. We made a decision about a week ago that only if there was a lot of people arrested would we have court [Sunday]," said Judge Francis X. Gorman, who volunteered for the Sunday shift. "It wouldn't be worthwhile [for less]."

Judge Gene Zmuda said Mondays are usually the busiest day for the court because they handle arraignments for those arrested during the weekend, so they wanted to have a contingency plan to make sure the judge scheduled to work today would not be overloaded.

The court was overwhelmed the last time the neo-Nazi groups came to Toledo. More than 120 people were arrested during the Oct. 15 riot in North Toledo, the judges said.

"The good news is there weren't nearly as many arrests as there were in October," Judge Zmuda said.

By yesterday evening, 10 of the 25 arrested people were still being held in the Lucas County jail. The others had posted bond and were released.

All were expected to be arraigned at 9 this morning in Toledo Municipal Court.

Twenty five adults and four juveniles were arrested for misdemeanor charges directly related to the neo-Nazi rally in Toledo on Saturday.
