Sentence delayed in 2 child assaults

2/8/2006

The sentencing hearing for an East Toledo man who sexually assaulted two young girls at a home in Monclova Township where he was installing a television satellite system was continued yesterday.

Timothy Conkright, 45, of Oak Street was to be sentenced by Lucas County Common Pleas Judge Frederick McDonald on three counts of rape and three counts of gross sexual imposition. A jury found Conkright guilty of the offenses Jan. 6.

However, Judge McDonald continued the hearing to Feb. 28, when he is expected to rule on a motion filed by Conkright's attorney, Martin Dow, asking for a new trial.

Conkright faces a mandatory sentence of 10 years to life in prison for each of the rape convictions, and an additional five years on each of the gross sexual imposition offenses.

The girls, then 4 and 5 years old, were sexually assaulted Oct. 30, 2004, on the porch of the home, but they kept quiet about the incident until June, when they told their parents they had been molested.

The victims, who lived in the neighborhood, identified Conkright as the person who assaulted them. Authorities used an invoice from the satellite business that showed Conkright had been in the home that day.

The motion asking for a new trial claims that evidence that was not previously available shows that Conkright made phone calls to the home during the time period the assaults occurred, indicating he was not at the residence when the girls were attacked.
