A Maumee man accused of helping three others beat another man outside a Springfield Township gas station was sentenced yesterday in Lucas County Common Pleas Court for his role in the assault.
Andrew Rose, one of four men charged in the attack Nov. 27 on Daniel Curtis, was sentenced by Judge James Bates to one year in prison. Rose, 25, of 2021 Stengel St. entered into a plea agreement Tuesday to a reduced charge of attempted felonious assault.
Mr. Curtis, 23, of Maumee suffered a broken jaw and other injuries in the attack that occurred shortly after midnight when he stopped at the BP gas station at Airport Highway and Holland-Sylvania Road.
The incident began while the victim was inside and one of the men approached two women in a car who were with Mr. Curtis. Authorities said Rose and a co-defendant attacked the victim when he asked them to leave his friends alone.
Mr. Curtis told Judge Bates that doctors operated for seven hours on his jaw, repairing multiple fractures with metal plates, and he was dealt a setback later when he suffered an infection, causing complications.
He said he incurred more than $50,000 in medical expenses, which he must pay because he was without health coverage. A recent college graduate, the victim said he had to turn down a teaching position while he was recuperating from his injuries.
"The bottom line is that I've accepted I'll always have health injuries because of this beating, a beating that was senseless and uncalled for," he said.
Judge Bates ordered that the one year be run consecutive to any prison sentence Rose would receive in Hamilton County Common Pleas Court in Cincinnati. At the time of the beating, Rose was on community control for a theft conviction.
Before Rose's sentencing, Donovan Dixie, 30, of 5940 Walnut Circle entered into a plea agreement to the same charge of attempted felonious assault and was found guilty by Judge Bates. He will be sentenced March 21. Dixie's brother, Anton, 25, of the Walnut Circle address, is charged with felonious assault. He is to go on trial next week.
A fourth defendant, Leo R. Frierson of Fostoria, has pleaded not guilty to felonious assault. Mr. Frierson is a former football player at the University of Toledo and was a defensive captain of the team during his senior year in 2001.
