Judge won t halt eviction of 3 disabled residents

U.S. District Judge James Carr has denied a preliminary injunction three disabled people wanted to halt an eviction from their residence.

The order stems from a lawsuit filed by the three in federal court in Toledo against the city of Toledo, Rosalie L. Reynolds, and Doukides Properties, owner of the home at 3842 Talmadge in West Toledo.

The lawsuit claims a city ordinance that prohibits their home from being within 500 feet of another group home is discriminatory and a violation of the Fair Housing Act and other federal laws.

Judge Carr granted a temporary restraining order on March 28, which allowed the three disabled men to continue living in the home, temporarily halting an eviction in Toledo Municipal Court.

The judge concluded in the most recent ruling last week that the city is not violating state and federal laws that prohibit discrimination against people with disabilities.
