Assault hearing of Toledo 17-year-old postponed

A probable-cause hearing in the case of a 17-year-old Toledoan charged in a shooting and robbery in which three men were wounded was continued yesterday after witnesses for the prosecution failed to appear in court.

A hearing in Lucas County Juvenile Court for John Harris III was continued to Nov. 8. He is charged with one count each of delinquency in connection with aggravated robbery and felonious assault for the Oct. 27 incident that began at a house at 962 Indiana Ave. and ended at Ann s Bar-B-Que in the 1000 block of Hawley Street.

Three men were shot in the legs. Two were released from the hospital; the third remains hospitalized.

Alan Konop requested that the charges be dismissed and that his client be on monitored release to his mother. Judge Denise Cubbon denied both requests and ordered that the teenager should be held in the county s juvenile detention center. Mr. Konop said the three witnesses who failed to appear were the victims.
